CRE Visual Solutions™ LLC
Terms & Conditions
Effective October 21, 2026
1. What these Terms cover
These Terms govern all photography, video, aerial, and 3D virtual tour services ordered from CRE Visual Solutions™ LLC (“CREVS”). By placing an order you (“Client”) accept these Terms. If you are ordering on behalf of a brokerage, firm, or property owner, you confirm you have the authority to accept these Terms on their behalf.
2. Authority to photograph the property
You confirm that you have the right and permission to have the property photographed, filmed, and scanned — including any permission required from the owner, landlord, property manager, or tenants. You are responsible for arranging site access and for notifying occupants. CREVS relies on your confirmation and is not responsible for obtaining that permission.
Tell CREVS in advance of any known site hazard, restricted area, or condition that affects safe access.
3. Copyright
CREVS and Zachary B. Mirer retain full copyright and ownership of all photographs, video, aerial footage, 3D scan data, and virtual tours produced (the “Work”), including raw and unpublished files. Payment purchases a license to use the Work — not ownership of it. No transfer of copyright occurs unless CREVS agrees to it in a separate written agreement signed by CREVS.
4. Your license to use the Work
On receipt of full payment, CREVS grants you a non-exclusive, non-transferable, perpetual license to use the Work to market, lease, or sell the specific property photographed. That license includes:
- Commercial listing platforms — LoopNet, Crexi, CoStar, and comparable services
- Your brokerage’s website, offering memoranda, brochures, flyers, and email marketing
- Your own and your brokerage’s social media accounts
- Presentations, proposals, and pitch materials for that property
- Your personal track record and portfolio, after the property transacts
5. What the license does not permit
Without prior written permission from CREVS, you may not:
- Sell, license, sublicense, rent, or transfer the Work to any third party
- Provide the Work to a newspaper, magazine, news outlet, wire service, blog, or any other publication — including editorial use
- Provide the Work to another photographer, media company, marketing agency, or vendor for their own use
- Use the Work to market a property other than the one photographed
- Alter the Work in a way that misrepresents the property, or remove any watermark, metadata, or credit
- Register, claim, or assert copyright in the Work
6. If someone else wants the images
Requests from press, publishers, property owners, tenants, co-brokers, or any other third party must be forwarded to CREVS. CREVS licenses directly, responds promptly, and frequently grants permission at no cost where it serves your listing. Forwarding the Work instead of the request is a breach of these Terms.
Unauthorized use — by you, or by anyone you provide the Work to — is billed at three times (3×) CREVS’s then-current standard license fee for that use, in addition to any other remedy available at law.
7. CREVS portfolio and promotional rights
CREVS may use the Work for its own portfolio, website, social media, advertising, awards, case studies, and client presentations, in perpetuity. If a property is off-market, confidential, or under an embargo, tell CREVS in writing before the shoot and CREVS will withhold the Work from public promotional use until you release it.
8. Payment
Orders are placed without upfront payment. Payment in full is due on delivery of the Work, and delivered files, virtual tours, and downloads remain locked until payment is received. No license under Section 4 takes effect until payment is made, and accessing or capturing the Work before payment — by screenshot, screen recording, or any other means — is not licensed use.
Unpaid balances must be settled before CREVS schedules further work for you or your brokerage.
Where a manual FAA airspace authorization is required, the FAA Airspace Coordination fee ($95) is due once the filing is submitted to the FAA, regardless of cancellation.
9. Rescheduling and cancellation
- Reschedule more than 24 hours before the scheduled start: no charge, for any reason.
- Reschedule inside 24 hours: no charge for the first reschedule per booking. Each additional reschedule of the same booking adds $95 to the order.
- Cancel more than 24 hours before the scheduled start: no charge.
- Cancel inside 24 hours: 50% of the package price is invoiced and due on receipt.
- No access on arrival — locked property, incorrect gate or lock code, tenant refusal, occupant not ready, or no one present to provide access: the shoot is treated as performed and the full package price is invoiced and due. CREVS will return once at no additional charge if the shoot is rebooked within 30 days.
- The FAA Airspace Coordination fee is due once filed, regardless of cancellation.
- Amounts due under this section must be paid before CREVS schedules further work.
10. Weather and conditions beyond our control
If weather, wind, visibility, airspace restriction, smoke, or any other condition outside CREVS’s control prevents safe or acceptable capture, CREVS will reschedule at no charge and no cancellation fee applies.
If conditions allow the ground and interior work but ground the drone under FAA Part 107 rules, CREVS will deliver the completed portion and return once for the aerial work at no additional charge.
11. Reshoots
Once the Work is delivered, a reshoot is a new booking at CREVS’s then-current rates. Changes to the property after the shoot — new signage, tenant improvements, seasonal change, or a re-list — are a new booking.
Exception: if delivered files fall below CREVS’s stated delivery standard, CREVS corrects them at no charge.
12. Delivery
Photo packages and Matterport virtual tours: two business days from the shoot (a Friday 5:00 p.m. shoot delivers Tuesday 5:00 p.m.; weekends excluded). CRE Video Brochure™: three business days from the shoot; when produced from client-supplied footage, three business days from receipt of complete footage. Custom video production and Special Requests are scoped and scheduled per project; no standing timeline applies. Delivery is made through the CREVS client portal.
13. File retention and re-delivery
Download and store your files when they are delivered. CREVS maintains delivered files in the client portal for 12 months from delivery and makes no guarantee of availability after that period. Re-delivery of archived files, where available, is $95. Raw and unprocessed files are not delivered unless purchased as the Raw Video Files add-on, and are otherwise retained at CREVS’s discretion.
14. Virtual tour hosting
Matterport virtual tours are hosted by CREVS on the Matterport platform. Hosting is included for 12 months from delivery.
After the included period, hosting continues at CREVS’s then-current hosting rates. CREVS will notify you before the included period ends.
If hosting is not renewed, the tour is deactivated and its link stops working. CREVS holds the tour in archive for 90 days after deactivation. Reactivation within that window is $39 and restores the original tour link. After 90 days the tour may be permanently deleted.
Hosting depends on the continued availability of the Matterport platform and is subject to Matterport’s own terms. CREVS is not responsible for platform outages, feature changes, or discontinuation by Matterport.
15. Measurement and accuracy
CREVS digital twins are captured with the Matterport Pro3 LiDAR camera, accurate to approximately ±20mm at a 10-meter range under controlled conditions. Measurement reliability is highest on points within 10 meters of a scan position; beyond that range, points are suitable for general spatial reference, not precision measurement.
CREVS deliverables are a visual and spatial record for documentation, coordination, and communication. They are not survey-grade data and are not a substitute for professional land surveying, engineering measurement, or a stamped as-built. Do not rely on CREVS digital twins for measurement-critical decisions, tolerance verification, clearance coordination, fabrication, or any determination requiring legally defensible accuracy. Verify all critical dimensions independently.
16. Drone operations
Aerial work is performed under FAA Part 107. Airspace authorizations are obtained per operation — LAANC where available, and written FAA authorization where a manual filing is required, which the FAA may take up to 90 days to review. CREVS will not fly an operation that cannot be performed legally and safely.
If an authorization is denied or not issued in time, CREVS will deliver the remainder of the package and, at your choice, refund the aerial portion or reschedule the aerial work.
17. Limitation of liability
CREVS’s total liability for any claim arising from an order is limited to the amount you paid for that order. CREVS is not liable for indirect, incidental, or consequential damages, including lost transactions, lost commissions, or lost marketing opportunity.
18. Indemnification
You agree to indemnify and hold CREVS harmless from any claim arising out of your use of the Work, your lack of authority to have the property photographed, or use of the Work by any third party to whom you provided it.
19. Governing law
These Terms are governed by the laws of the State of Nevada. Any dispute arising from them is brought in the state or federal courts located in Clark County, Nevada.
20. Changes to these Terms
The Terms in effect on the date of your order govern that order. CREVS may update these Terms for future orders.
21. General
If any provision of these Terms is found unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver of it. These Terms, together with your order, are the entire agreement between you and CREVS for the services ordered and replace any prior discussion or understanding.
22. Electronic acceptance
Checking the acceptance box and completing checkout is your electronic signature and forms a binding agreement under the federal E-SIGN Act and Nevada’s Uniform Electronic Transactions Act. CREVS records the date, time, and account of acceptance.
